1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Pendulyn", "we", "us", "our" — the workshop business operating at 9 Jalan Sultan Iskandar, 30000 Ipoh, Perak, Malaysia.
- "Client", "you", "your" — any person who submits an enquiry, enters into a programme agreement, or uses this website.
- "Programme" — any of the three defined repair and service programmes offered by Pendulyn: Clock Movement Service, Mainspring and Barrel Renewal, or Heritage Longcase Programme.
- "Clock" or "Piece" — the mechanical clock or related item entrusted to us for assessment or programme work.
- "Programme Agreement" — the written or verbal confirmation between Pendulyn and the client that a specific programme will be carried out at the agreed price.
- "Website" — the website operated by Pendulyn at the domain associated with this policy.
- "Coverage Period" — the 24-month period following completion of a programme during which service-related faults are attended to without additional charge.
2. Acceptance of Terms
By using this website, submitting an enquiry, or entering into a Programme Agreement with Pendulyn, you confirm that you have read and agree to these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. Where you are acting on behalf of another person — for example, arranging a programme for a clock that belongs to an elderly relative — you confirm that you have the authority to do so.
If you do not agree to these terms, you should not use the website or proceed with an enquiry.
3. Service Description
Pendulyn offers three defined clock repair and restoration programmes for mechanical timepieces. Full details of each programme — scope, inclusions, turnaround and price — are set out on our Solutions page and in any written quotation provided.
Our services are primarily available to clients within Malaysia. For the Heritage Longcase Programme, site visits are offered within Perak as standard; arrangements for other locations are made on a case-by-case basis and may carry an additional travel allowance agreed in advance.
We reserve the right to decline a programme enquiry if, in our assessment, the piece is not suitable for the programme described, or if the scope of work required falls outside our capabilities.
4. Your Responsibilities
When submitting an enquiry or entering into a programme, you agree to:
- Provide accurate information about the clock, including any known history of prior repair work
- Disclose any known fragility, damage or features of the piece that may affect how it should be handled
- Ensure that you are the owner of the piece or have the authority of the owner to commission programme work
- Arrange safe delivery or collection of the piece as agreed
- Respond to our communications within a reasonable period so that the programme can proceed
- Use the website for lawful purposes only and not attempt to damage, interfere with or misuse its content or functionality
5. Intellectual Property
All content on this website — including text, programme descriptions, images and layout — is the property of Pendulyn or is used with permission. You may view and use this content for personal, non-commercial purposes only.
You may not copy, reproduce, distribute or publish any part of this website without our prior written consent. Photography and documentation produced by Pendulyn as part of a Heritage Longcase Programme — photographic records, condition notes, joinery reports and maintenance calendars — are supplied to the client for personal and reference use; commercial use or redistribution requires our written permission.
6. Payment Terms
All programme fees are quoted and invoiced in Malaysian Ringgit (RM). The programme price agreed before work begins is the price invoiced on completion. No additional parts charges or labour items will appear on the final invoice unless a scope change was agreed in writing during the programme.
Payment is due on completion of the programme and before collection or return of the piece. We accept bank transfer and cash. Payment terms for specific arrangements — including deposit requirements for the Heritage Longcase Programme — are agreed in writing before the programme commences.
Cancellation and Scope Changes: If you cancel a programme after work has commenced, reasonable costs incurred to that point may be charged. If the assessment reveals that the scope differs materially from what was initially described, we will contact you with a revised quotation before proceeding. You may decline the revised scope without obligation for work not yet done.
Coverage Period: The 24-month coverage period applies to faults demonstrably related to the programme work. Faults arising from mishandling, further damage or unrelated causes are not covered. Coverage does not constitute a product warranty under the Consumer Protection Act 1999 unless the specific provisions of that Act require otherwise.
7. Disclaimers
While we carry out all programme work with care and skill, we cannot undertake that any particular outcome — such as a specific rate accuracy or continuous running life — will be achieved. Clock movements vary significantly in condition, design and history, and outcomes depend on factors beyond our control.

8. Limitation of Liability
To the extent permitted by Malaysian law, Pendulyn's liability to you in connection with a programme or with your use of this website is limited to the price paid for the programme in question. We are not liable for:
- Indirect, consequential or economic loss
- Loss of sentimental or antique value where such loss was not caused by our negligence
- Delay caused by factors outside our control, including parts availability or force majeure events
- Damage to a piece arising from undisclosed pre-existing conditions
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded under the Consumer Protection Act 1999 or other applicable Malaysian law.
9. Indemnification
You agree to indemnify Pendulyn against any claims, costs or damages arising from your misuse of the website, your breach of these terms, or your provision of false or misleading information in connection with a programme enquiry or agreement.
10. Termination of a Programme Agreement
Either party may terminate a Programme Agreement before work is complete by giving written notice. If we terminate due to circumstances beyond our control or because the piece cannot be safely worked on as described, we will return the piece without charge for work not yet done.
If you terminate after work has commenced, a charge for work completed to that point may apply, as set out in Section 6. The 24-month coverage period survives completion but does not apply to partially completed programmes.
11. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from our services or from the use of this website shall first be referred to informal resolution by contacting us at [email protected]. We will respond within 14 working days.
If informal resolution is not achieved, disputes shall be subject to the jurisdiction of the courts of Malaysia, with Perak as the preferred venue.
12. General Provisions
- Entire Agreement: These terms, together with any written programme quotation or agreement, constitute the entire agreement between the parties for the programme in question.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Our failure to enforce any provision on a given occasion does not waive our right to enforce it subsequently.
- Assignment: We may assign our obligations under a Programme Agreement to a suitably qualified successor in the event of a change of workshop ownership, subject to equivalent service terms. You may not assign your obligations without our written consent.
- Notices: Written notices may be sent by email or post. Email to [email protected] is acceptable for formal correspondence.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. Material changes will be indicated by a revised date at the top of this page. Continued use of the website or submission of a new enquiry after an update constitutes acceptance of the revised terms.
